These Terms and Conditions (“Terms”) govern your use of smsmarketingdata.com (the “Site”) and any products you purchase from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Products and Services
SMS Marketing Data sells digital marketing data products, including mobile number databases, email lists, and related lead lists, along with free tools and educational content. Data products are delivered as digital files. Nothing on the Site is a physical product, and no software is installed.
2. Ordering and Payment
To place an order, submit the order form with your name, email address, WhatsApp number, the product you want, and your preferred payment method. Our standard price is $150 per 100K records. Larger or custom orders are quoted individually.
We accept Payoneer, USDT, and BTC. Your order is confirmed once your payment is confirmed. Prices are shown in USD. You are responsible for any fees charged by your payment provider or network.
3. Delivery
Digital products are delivered as CSV files to the email address you provide on the order form, after payment confirmation. Delivery times vary with the payment method: crypto payments confirm on the blockchain, while Payoneer transfers follow Payoneer’s own processing times. If you have not received your file within 48 hours of confirmed payment, contact us and we will resolve it.
It is your responsibility to provide a correct email address and to check your spam folder.
4. Refunds
Because our products are digital files delivered by email, all sales are final once the file has been delivered. Before you order, confirm that the product, volume, and fields match your needs. Ask us if anything is unclear.
If the file you receive is corrupted, unreadable, or substantially different from what was described, tell us within 7 days of delivery and we will replace it or fix the problem. Refunds are issued only where required by applicable law.
5. Acceptable Use and Compliance
You are solely responsible for how you use any data you purchase. You agree to:
- Comply with all applicable laws, including the US Telephone Consumer Protection Act (TCPA), state telemarketing laws, and equivalent regulations in any country you contact.
- Obtain any consent required before sending marketing texts or calls.
- Scrub your lists against the National Do Not Call Registry and any applicable state or internal do-not-call lists.
- Honor opt-out requests immediately.
- Respect quiet hours and any time-of-day restrictions that apply.

We may refuse or cancel orders, at our discretion, where we have reason to believe the purchase would be used unlawfully.
6. Intellectual Property
The content on this Site, including guides, tools, images, and design, is our property or used under license. Data files you purchase are licensed to you for your own marketing use. You may not resell or redistribute our data files or Site content as a competing product.
7. Disclaimers
The Site, its tools, and its content are provided “as is” without warranties of any kind. We do not guarantee deliverability, response rates, or campaign results from any data product. Marketing outcomes depend on your offer, your compliance, your sending infrastructure, and many factors outside our control.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Site or products is limited to the amount you paid for the product in question. We are not liable for indirect, incidental, or consequential damages, including lost profits or penalties arising from your campaigns.
9. Changes to These Terms
We may update these Terms from time to time. The version in force is the one published on this page, with its last-updated date. Continued use of the Site after changes means you accept the updated Terms.
